Acceptable Use, Privacy, and Security Policies

WallJammer with it's agents, subsidiaries and parent company, Over The Top Graphics LLC comprises many Internet companies. As such, we feel it is important to set an appropriate example in the areas of Security, Customer Service Standards, Privacy Policies, and Acceptable Use Policies.

WallJammer is committed to honoring the privacy of our members. This privacy policy covers personally identifiable information used to provide our services. When you register as a member of one of our accounts, we ask you for your name, contact information, and certain demographic information. This information lets us provide personalized services and communicate separately with you. We also use aggregated information about the use of our services to evaluate our users' preferences, and to improve our programming.

Like most websites, we use small bits of data called cookies stored on users' computers to simulate a continuous connection. Cookies let us "remember" information about your preferences and passwords and allow you to move within our service without reintroducing yourself. Recent versions of Netscape and Internet Explorer browsers let you easily see and control cookies. While we need certain information to register you as a unique user and let you access personalized services, other requested information is optional and may be given at your discretion.

It is important that we have your full name, email address and telephone number in the event we need to contact you concerning any order for delivery of services. Without this information being correct, it could impede our ability to deliver the services you have purchased. It is very important that the information you enter upon registration is correct for this reason. We send out updates by email to all members, notifying them of specials and upgraded features of our services. You can elect not to receive communications from us or from other parties. However, when removing yourself from our database will also remove your entire profile, thereby disabling your access to our member’s site.

We encourage members to update and edit their personal information and keep it current. You can easily correct or update your personal information at any time via our member’s site by clicking on “Edit Personal Profile”.

All user information is stored in databases protected via a variety of access controls that are only accessible by company staff. This data is accessed only for the purposes specified in this privacy statement and used solely for enhancing our services provided to our members. We do not share personally identifiable data with other companies for any purpose. Everyone who registers as a member of WallJammer services is never sold or distributed to any other company for any reason. This member database is kept separate from all other databases. WallJammer may, at some point in the future, hire an outside agent to provide certain services to you, and would therefore need to provide them with our member information. In this event, all partners would be required to use member data within the framework of this same policy statement. It is our goal to build trust and confidence in our members by promoting fair information practices. Our desire to have a long-lasting and profitable relationship with our members is built on the highest standards and integrity.

Privacy:

Information provided to WallJammer will never be provided to any 3rd party - unless you give express permission to do so. We respect your privacy and do not partake in the practice of selling customer information for any reason. We will never use your personal or business information in any way that violates your privacy. When you provide any information to us, it will only be used in such a manner as has been made clear to you, with your acknowledgement and permission.

Security:

Any critical data (financial or otherwise) transmitted to us is done so using the strongest encryption algorithm available for secure financial transaction on the Internet. We take every precaution we can to protect your data.

Acceptable Use:

Anyone who uses our services must abide by the following widely accepted standards of acceptable use:

a.) Abuse:

We do not partake in any form of Internet abuse and will not tolerate those that do (zero tolerance). If any of our customers or members using our services or software are accused of using these tools for any activity generally recognized as net abuse (including but not limited to: unsolicited mailings, unsolicited newsgroup postings, email harvesting, rogue endless pop-ups or malicious scripts), we will investigate the matter aggressively and swiftly. Accounts found to be in violation of this policy are subject to immediate termination at the sole discretion of appropriate Over The Top Graphics LLC and WallJammer staff members. WallJammer is always willing to receive as well as swiftly investigate and act on abuse reports.

b.) Mailing List Management:

All mailing lists at WallJammer are maintained via an opt-in method that records the IP address of the person subscribing to the particular list. We are currently in the process of developing a confirmed opt-in system for all subscriptions. In the meantime, we are aggressively tracking anyone who may subscribe someone to one of our lists without their permission. Anyone subscribing someone to a list without their permission will have this activity reported to the abuse department of the owner of the IP block in question and the abuse department of its upstream encouraging the termination of the abusing user. Any mailing sent from WallJammer will always includes a clear and easy unsubscribe link. Anyone using any of WallJammer's products and services in conjunction with any mailings must also abide by these standards.

c.) Fraud:

We take fraud quite seriously and will aggressively prosecute any fraudulent transaction conducted using our networks or products in any way shape or form. All fraud attempts will be reported to the Secret Service (the arm of the U.S. Treasury Department that prosecutes Internet fraud), the owner and upstream of the IP block related to the fraud, and any other agencies as we see fit in order to terminate, prosecute, and otherwise seek justice against the perpetrators of said fraud. Fraud violates the trust of the Internet as a whole and lessens consumer confidence in the Internet. As such, we take it quite seriously.

ANTI-SPAM POLICY

The marketing of any WallJammer, Over The Top Graphics LLC web sites (or System components) is strictly prohibited if done through the transmission of unsolicited e-mail, also known as SPAM.

Any e-mail advertising must be done pursuant to a prior personal or business relationship with the e-mail recipient, including but not limited to having obtained their e-mail address through a verifiable opt-in procedure.

We also strictly prohibit the marketing of any WallJammer, Over The Top Graphics LLC web sites (or System components) by the transmission of e-mail that makes use of or contains invalid or forged headers, invalid or non-existent domain names or any other means of deceptive addressing (counterfeit e-mail).

We also strictly prohibit the marketing of any WallJammer, Over The Top Graphics LLC web sites (or System components) by the transmission of e-mail that is relayed from any third party's mail servers without the permission of that third party, or which employs similar techniques to hide or obscure the source of the e-mail.

The transmission of unsolicited bulk e-mail, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender under applicable federal and/or state law. We do not authorize the harvesting or collection of screen names or e-mail addresses from any ISP service for the purpose of sending unsolicited e-mail, and will terminate any client determined to have transmitted unsolicited e-mails advertising any web sites (or System components) marketed through our Program to lists gathered by such methods.

HOW TO REPORT UNSOLICITED E-MAIL (SPAM)

If you believe you are the recipient of unsolicited e-mail (SPAM) from a person or company advertising web sites under our Program, please follow this procedure to report the offender. Please e-mail your SPAM complaint to our E-mail Abuse Department. The best (and easiest) way to do this is by forwarding the offending e-mail to: Customer Care. Please include your name, address, telephone number and any information you may have about the identity of the person or entity that sent the the offending piece of e-mail to you.
